The Council of Islamic Ideology (CII) in Pakistan announced that there is no need for seeking consent from the first wife for a second marriage.
According to Sharia, a man is not bound to seek the first wife’s permission before contracting a second marriage.
Even if a man wants third marriage for some solid reasons, he is all free to do it without the permission of his first two wives.
It is pertinent to mention that “A man is only allowed to marry for more than one time if treat all his spouses with justice and equity.”
What does Islam say about second marriage?
“And if you fear that you will not deal justly with the orphan girls, then marry those that please you of [other] women, two or three or four. But if you fear that you will not be just, then [marry only] one or those your right hand possesses. That is more suitable that you may not incline [to injustice]”. Surah An-Nisa [4:3] – Al-Qur’an al-Kareem
The Last Prophet (S.A.W.W.) indicated that one wife is always preferable so that a man does not expose himself to the risk of treating his wives unfairly when he is required to maintain fairness between them at all times.
Pakistan’s law about second marriage
The procedure of marrying the second time without the consent of the first wife is quite complex.
For this purpose, the Husband can apply for permission in the union council. According to the second marriage laws in Pakistan the man needs to take help from the union council. But there should be solid grounds for second marriage. Only then the union council can permit the husband for second marriage in Pakistan.
The reasons should include Sterility, physical infirmity, and physical unfitness for the conjugal relation.
In case, a husband marries another woman without the consent of the first wife or the union council. He will get punishment of one year and as well fine of Rupees of five hundred thousand. He is punished under the law of the land, but his second marriage will remain valid.
